The Senate met at 6 p.m.
(Senator Tomblin, Mr. President, in the Chair.)
Prayer was offered by the Honorable Brooks F. McCabe, Jr., a
senator from the seventeenth district.
Pending the reading of the Journal of Saturday, November 11,
2006,
On motion of Senator Fanning, the Journal was approved and the
further reading thereof dispensed with.
The Senate proceeded to the second order of business and the
introduction of guests.
At the request of Senator Chafin, and by unanimous consent,
the provisions of rule number fifty-four of the Rules of the
Senate, relating to persons entitled to the privileges of the
floor, were suspended in order to grant Mrs. Charles C. Lanham
privileges of the floor for the day.
The Senate then proceeded to the sixth order of business.
Senators Weeks, Tomblin (Mr. President), Bailey, Barnes, Boley, Bowman, Caruth, Chafin, Deem, Dempsey, Edgell, Facemyer,
Fanning, Foster, Guills, Harrison, Helmick, Hunter, Jenkins,
Kessler, Lanham, Love, McCabe, McKenzie, Minard, Minear, Oliverio,
Plymale, Prezioso, Sharpe, Sprouse, Unger, White and Yoder offered
the following resolution:
Senate Resolution No. 203--Memorializing the life of Charles
Smith II, Detective Corporal of the Beckley Police Department and
dedicated public servant.
Whereas, Charles Smith II was born July 5, 1977, in Raleigh
County, the son of Charles Smith and Sonya Meadows Smith; and
Whereas, Charles Smith II graduated from Independence High
School in 1995, where he excelled in wrestling, and later became
the head wrestling coach at Woodrow Wilson High School and
assistant wrestling coach at Park Junior High School; and
Whereas, Charles Smith II also excelled in amateur golf,
winning the 2004 Club Championship at Grandview Country Club; and
Whereas, Charles Smith II was a veteran of the United States
Marine Corps and served a tour of duty in Japan; and
Whereas, Charles Smith II was a proud member of the Beckley
Police Department for more than five years where he rose to the
rank of detective corporal in the narcotics unit; and
Whereas, Charles Smith II was married to his beloved wife,
Britney, with whom he shared the joy of having a daughter, Taylor;
and
Whereas, Sadly, Detective Corporal Charles Smith II was killed
in the line of duty on Tuesday, August 29, 2006; therefore, be it
Resolved by the Senate:
That the Senate hereby memorializes the life of Charles Smith
II, Detective Corporal of the Beckley Police Department and
dedicated public servant; and, be it
Further Resolved, That the Senate extends its sincere sympathy
at the passing of Charles Smith II; and, be it
Further Resolved, That the Clerk is hereby directed to forward
a copy of this resolution to the family of the late Charles Smith
II.
At the request of Senator Weeks, unanimous consent being
granted, the resolution was taken up for immediate consideration
and reference to a committee dispensed with.
The question being on the adoption of the resolution, and on
this question, Senator Weeks demanded the yeas and nays.
The roll being taken, the yeas were: Bailey, Barnes, Boley,
Caruth, Chafin, Deem, Dempsey, Edgell, Facemyer, Fanning, Foster,
Guills, Harrison, Helmick, Hunter, Jenkins, Kessler, Lanham, Love,
McCabe, McKenzie, Minard, Minear, Oliverio, Plymale, Prezioso,
Sharpe, Sprouse, Unger, Weeks, White, Yoder and Tomblin (Mr.
President)--33.
The nays were: None.
Absent: Bowman--1.
So, a majority of those present and voting having voted in the
affirmative, the President declared the resolution (S. R. No. 203)
adopted.
Thereafter, at the request of Senator Sprouse, and by
unanimous consent, the remarks by Senator Weeks regarding the
adoption of Senate Resolution No. 203 were ordered printed in the
Appendix to the Journal.
On motion of Senator Chafin, the Senate recessed for one
minute.
Upon expiration of the recess, the Senate reconvened and
proceeded to the seventh order of business.
On motion of Senator Love, the special order of business set
for this position on the calendar (consideration of executive
nominations) was postponed and made a special order of business
under unfinished business on tomorrow, Monday, November 13, 2006.
The Senate next proceeded to the twelfth order of business.
Remarks were made by Senators Fanning, Sprouse, Weeks and
Lanham.
Thereafter, at the request of Senator Sprouse, and by
unanimous consent, the remarks by Senators Weeks and Lanham were
ordered printed in the Appendix to the Journal.
Pending announcement of a meeting of a standing committee of
the Senate,
On motion of Senator Chafin, the Senate adjourned until tomorrow, Monday, November 13, 2006, at 6 p.m.
